TERMS AND CONDITIONS

 

  • Application of these terms and conditions
    • These terms and conditions apply to membership of the Aston Villa Pride Rewards Programme operated by Aston Villa Football Club Limited (“AVFC”).
    • These terms and conditions are in addition to:
      • the terms and conditions governing the use of Season Cards (which are applicable to Season Card Holders only), including AVFC’s ground regulations and any other conditions of entry to Villa Park;
      • the terms and conditions governing membership of the Claret, Cubs, Villans, Claret Lite, Global, Women’s Team and Little Villans Membership Programmes;
    • In utilising the Pride Rewards Programme, Pride Rewards Members are deemed to have accepted and agreed to these terms and conditions.
  • Definitions and Interpretation

In these terms and conditions, the following words and phrases shall have the following meanings (unless stated otherwise):

  • “AVFC”: Aston Villa Football Club Limited;
  • “Claret Membership Card”: the electronic card (and any replacement thereof) issued by AVFC to Claret Members in respect of the Claret Membership Programme.
  • “Claret Member”: a member of the Claret Membership Programme;
  • “Claret Membership Programme”: the programme run by AVFC referred to as the Claret Membership or Claret Members Programme which includes (amongst other things) priority access for away tickets;
  • “Cub Member”: a member of the Cub Membership Programme;
  • “Cub Membership Programme”: the programme run by AVFC referred to as the Cub Membership or Cub Members Programme which is aimed at AVFC’s junior fans;
  • “Pride Rewards Member”: each person who is registered as an official member of the Pride Rewards Programme;
  • “Pride Rewards Membership”: each Pride Rewards Member’s membership of the Pride Rewards Programme;
  • “Pride Rewards Page”: the page on the Website dedicated to the Pride Rewards Programme (currently at avfc.co.uk/rewards);
  • “Pride Rewards Programme”: the loyalty programme run by AVFC referred to as Pride Rewards and subject to these terms and conditions;
  • “Programme End Date”: 1st July 2024;
  • “Rewards”: rewards which Pride Rewards Members may be entitled to receive (subject to availability and the Pride Rewards Member having sufficient Reward Points at the relevant time) by redeeming some or all of their accumulated Reward Points under the Pride Rewards Programme;
  • “Reward Points”: points earned by Pride Reward Members and awarded by AVFC in accordance with the Pride Rewards Programme which may be redeemed in exchange for Rewards;
  • “Season Card”: the electronic card (and any replacement) issued by AVFC which, amongst other things, admits the holder into Villa Park at matches which that holder is entitled to attend as further described in the relevant terms and conditions;
  • “Season Card Holder”: means a holder of a Season Card; and
  • “Villa Park”: AVFC’s first team stadium, currently known as Villa Park and situated at Trinity Road, Birmingham B6 6HE; and
  • “Website”: AVFC’s website at avfc.co.uk.

Eligibility for and operation of the Pride Rewards Programme

  • Subject to condition 4 below, the Pride Rewards Programme is available to Season Card Holders and members (Claret, Cubs, Villans, Claret Lite, Global, Claret Women’s Team) only.
  • Season Card Holders who have been issued a Season Card on a complimentary basis (which includes Disabled Companions) are ineligible to participate in the Pride Rewards Programme (unless they are participate as a Season Card Holder of a paid for Season Card, as a Claret Member or as a Cub Member).
  • Pride Rewards Members who are eligible to participate in the Pride Rewards Programme are automatically enrolled but must activate their own account by visiting the Pride Rewards Page.
  • Pride Rewards Membership is not transferable and can only be used by the named Pride Reward Member.
  • The Pride Rewards Programme will finish on the Programme End Date. On this date, all Reward Points which have been earned but not used will be cancelled and will not be capable of use.
  • Reward Points and Rewards
  • Details of how Pride Rewards Members can earn Reward Points and the Rewards available to Pride Rewards Members are available on the Pride Rewards Page. Any Rewards and/or offers may be changed at any time.
  • There are limits on the number of Reward Points that can be earned and/or redeemed during any period of time. Details are available on the Pride Rewards Page. These may be changed at any time.
  • Unless otherwise cancelled or withdrawn in accordance with these terms and conditions, Reward Points which are validly earned will be credited to the Pride Rewards Members’ account until such time as the Pride Rewards Member wishes to redeem them against available Rewards.
  • Where Reward Points are used to bid in any auction for any Reward, those Reward Points will not be capable of being redeemed on other Rewards unless and until the relevant auction has closed and the Pride Rewards Member has been unsuccessful in the auction. The winner of the auction will have their points removed to the amount of their final bid.
  • Where Reward Points are used to gain entry to any prize draw, competition or other similar Reward, those Reward Points will not be refunded to entrants who do not win that Reward.
  • Reward Points are not transferable and can only be used by the named Pride Reward Member.
  • Items which are redeemed using Reward Points will only be held by the Club for collection by a Pride Rewards Member for six months after the date of purchase. If the item(s) is/are not collected within that time, the Club shall be entitled to re-sell the item(s) and the Club shall not refund any Reward Points which were used in such purchase.
  • Reward Points may only be redeemed on Rewards and may not be used for any other purpose. Reward Points have no equivalent or representative cash value. No cash alternative will be offered for any unused Reward Points which remain on a Pride Rewards Member’s accounts or have been cancelled.
  • Reward Points and Rewards are not refundable, exchangeable, replaceable or transferable for cash or credit. Reward Points may not be assigned, transferred or pledged to any third party. Pride Rewards Members have no property rights or other legal interest in any Reward Points that may accumulate in their account.
  • AVFC is not liable, at any point, for any Reward Points which are fraudulently redeemed should an account be misused or in the event a Season Card or membership card is lost/stolen and not reported to AVFC.
  • AVFC reserves the right to remove or cancel any Reward Points awarded if AVFC determines (or reasonably suspects) that the Reward Points were awarded in breach of these terms and conditions or in error.
  • AVFC reserves the right to limit any Reward offered by number and by time. The Pride Rewards Member accepts that some or all Rewards may be limited by number and will be awarded to Pride Rewards Members on a first come, first served basis.
  • No refund or cash alternative will be offered for any Reward received (including entries to any prize draw, competition or other such similar Reward).
  • On 21st July in each year, any Reward Points that have been earned prior to 21st July in the previous year but are unused, will be cancelled and will not be capable of use. In addition, all other Reward Points which have been earned but not used as at the Programme End Date will be cancelled and will not be capable of use.
  • AVFC reserves the right to run Pride Rewards Programme joining incentive and other loyalty programmes from time to time without liability to existing Pride Rewards Members.

Changes to the Pride Rewards Programme and these terms and conditions

  • AVFC reserves the right to change or amend these terms and conditions at any time by publishing the changes on its Website, provided that such changes:
    • are minor or trivial;
    • shall not, in AVFC’s opinion, adversely impact the Pride Rewards Member and/or their membership of Pride Rewards Programme;
    • reflect changes required by in relevant laws and regulatory requirements; or
    • do not come into effect until at least 14 days after publication.
  • AVFC reserves the right to change or amend, at any time (by giving details on the Pride Rewards Page):
    • the Pride Rewards Programme (including, but not limited to, its name and branding);
    • the Rewards available within the Reward Points Programme;
    • how Rewards may be redeemed;
    • the number of points required to redeem any Reward;
    • the limitations (including time and numerical limits) on the availability of any Reward or the ability to redeem Reward Points;
    • how Reward Points are earned;
    • the limits on the number of Reward Points than can be earned during any period of time;
    • the number of Reward Points that are earned in relation to any action or purchase; and
    • the maximum number of Reward Points that may be earned or redeemed in any period.
  • AVFC reserves the right, at its sole discretion to introduce other loyalty programmes, membership programmes or other such programmes from time to time without liability to Pride Rewards Members.
  • AVFC reserves the right, at its sole discretion to transfer Pride Rewards Members to such additional or replacement loyalty programmes without prior notice provided always that the Pride Rewards Member shall be entitled to the same or substantially similar benefits under the new loyalty programme as the Pride Rewards Member was under the Pride Rewards Programme.
  • The advice or actions of AVFC’s staff will not have the effect of changing these terms and conditions.

 

Rules and Regulations of Entry to Raffles & Auctions

  • The following rules apply to the ‘Score at the Holte’ raffle activation:
    • 3 winners will be selected at random from all entries to take part at the designated game, and will receive communication from the club via email in the days prior to the game
    • 6 targets will be hung from the goal posts and fans will win a prize if they manage to hit one of the targets.
    • Each fan will take one penalty only.
    • A hit of the target will be deemed as any part of the ball coming into contact with any part of the red circle of the target as the ball enters the net. The Fan Squad team there on the day will make the final decision on whether a ball has struck the target.
    • Prizes are subject to change from one game week to the next.
  • To enter and take part in the ‘Score at the Holte’ raffle, supporters must:
    • Have a valid membership or season ticket for the 22/23 season
    • Be 6 years of age or above (Junior fans 14 and under must be accompanied down to the pitch by a responsible adult)
    • Be wearing appropriate footwear on the day eg rubber soled trainers, nothing with a heel or stood which could damage the playing surface will be allowed
    • Not have any medical condition which would prohibit them from taking part
    • Be in their seat from atleast 5 minutes before the half time whistle is blown, ready for a member of the fan squad team to collect them
  • The following rules apply to the ‘Prize Where it Lies’ raffle activation:
    • 3 winners will be selected at random from all entries to take part at the designated game, and will receive communication from the club via email in the days prior to the game
    • A large target shaped banner will be laid out on the half way line. The banner will have 8 segments and a bulls eye, with each segment or bulls eye representing a different prize that the fan can win.
    • Each fan will take one shot from the dead ball line and if they land their ball on the target they will win a prize.
    • A hit of the target will be deemed as the full ball landing and stopping within one of the 8 segments or bulls eye on the target. The Fan Squad team there on the day will make the final decision on whether a ball has landed on the target banner.
    • Prizes are subject to change from one game week to the next.
  • To enter and take part in the ‘Prize Where it Lies’ raffle activation, supporters must:
    • Have a valid membership or season ticket for the 22/23 season
    • Be 18 years of age or above
    • Be wearing appropriate footwear on the day eg rubber soled trainers, nothing with a heel or stood which could damage the playing surface will be allowed
    • Not have any medical condition which would prohibit them from taking part
    • Be in their seat from atleast 5 minutes before the half time whistle is blown, ready for a member of the fan squad team to collect them

 

 

 

Termination and Cancellation

  • Unless terminated early in accordance with these terms and conditions, the Pride Rewards Programme will automatically terminate on the Programme End Date.
  • In the event that a Pride Rewards Member is a Season Card Holder and they do not renew their Season Card at the end of any season occurring before the Programme End Date, their Pride Rewards Membership will automatically terminate on 31 July following expiry of the Season Card (or such later date as AVFC may notify Pride Rewards Members, via the Pride Rewards Page, from time to time).
  • Pride Rewards Members can terminate their Pride Rewards Membership at any time by sending written notice by post to: Marketing, Aston Villa Football Club Limited, Villa Park, Birmingham B6 6HE or by email to: marketingteam@avfc.co.uk.
  • AVFC can terminate a Pride Rewards Member’s participation in the Pride Rewards Programme immediately on written notice if:
    • the Pride Rewards Member breaches these terms and conditions;
    • the Pride Rewards Member’s Season Card and/or Claret Membership and / or Cub Membership is suspended or withdrawn pursuant to any of the associated terms, conditions or regulations referred to in condition 1 above;
    • the Pride Rewards Member acts or is reasonably suspected of acting in any manner which is inconsistent with or violates these terms and conditions or any element of the Pride Rewards Programme;
    • the Pride Rewards Member acts, in AVFC's reasonable opinion, in a manner inconsistent with the applicable laws, statutes or ordinances or if there are reasonable grounds for suspecting fraud, theft, or dishonesty in connection with the Pride Rewards Programme;
    • the Pride Rewards Member is convicted (or AVFC reasonably suspects the Pride Rewards Member is guilty) of a sports-related criminal offence;
    • if the Pride Rewards Member is banned from Villa Park or any other sporting venue anywhere in the world;
    • AVFC reasonably believes an unauthorised person is accessing the Pride Rewards Programme using the Pride Rewards Member's account;
    • AVFC reasonably believes that providing the Pride Rewards Member with Reward Points will cause AVFC to break a law, regulation or code; or
    • AVFC reasonably believes it is necessary to do so for operational reasons.
  • AVFC can suspend a Pride Rewards Member’s participation in the Pride Rewards Programme (including, but not limited to access to the Pride Rewards Page and the ability to earn and redeem Reward Points) immediately on written notice if AVFC reasonably suspect that any of the matters set out in condition 32 above has occurred, for such period as AVFC may reasonably require to carry out an investigation.
  • AVFC may terminate or suspend the Pride Rewards Programme early by giving the Pride Rewards Member 30 days' notice at any time (which may by email).
  • On termination or cancellation of any Pride Rewards Membership for any reason (whether automatically, by AVFC or the Pride Rewards Member), all unused Reward Points connected to that Pride Rewards Member’s account will be cancelled and not capable of use. Where the Pride Rewards Member has used any of their Reward Points to earn a Reward which the Pride Rewards Member has not already received, any such Rewards shall be withdrawn and shall not be received by the Pride Rewards Member (this includes any ‘bids’ placed by the Pride Rewards Member in any auction for a Reward and entry to any prize draw, competition or similar Reward).
  • Where unused Reward Points are cancelled, removed or withdrawn (whether as a result of termination or cancellation of any Pride Rewards Membership, or otherwise), no refund, cash alternative or other replacement will be given to the Pride Rewards Member.
  • In the event that a Pride Rewards Membership is terminated or cancelled for any reason, AVFC reserves the right to, at its discretion:
    • exclude the relevant Member from applying (or re-applying) for any Membership Programme (and any future membership or loyalty (or similar) programmes maintained or organised by AVFC;
    • disqualify the relevant Member from applying for any Season Card, Match Ticket or other product or service offered by AVFC; and / or
    • notify FIFA, UEFA, The Football Association, The Premier League Limited and The Football League (EFL), football club, the police and / or any other regulatory or statutory authority of such exclusion and/or disqualification (and the reason(s) for such exclusion and/or disqualification).

Liability

  • Nothing in this agreement shall limit or exclude AVFC’s liability for:
    • death or personal injury caused by its negligence;
    • fraud or fraudulent misrepresentation; or
    • breach of the terms implied by section 2 of the Supply of Goods and Services Act 1982 (title and quiet possession) or any other liability which cannot be limited or excluded by applicable law.
  • Subject to condition 38 above, AVFC will not be liable to any Member for any loss or damage, whether in contract, tort (including negligence), breach of statutory duty, or otherwise arising under or in connection with:
    • any failure or delay by AVFC in carrying out any of its obligations under these terms and conditions which is caused by circumstances outside of AVFC’s reasonable control;
    • the Pride Rewards Programme and the Reward Points;
    • any information provided to AVFC by a third party;
    • The Website and the Pride Rewards Page, including its availability and use of or reliance on any content displayed on the Pride Rewards Page; and
    • any act or omission of a third party providing the Reward Points Rewards

save to the extent that such loss or damage is foreseeable by AVFC and the Pride Rewards Member at the date these terms and conditions became binding and arises directly as a consequence of AVFC’s breach of these terms and conditions.

  • Subject to condition 38 above, AVFC shall have no liability whatsoever for any indirect or consequential loss or damage, loss of enjoyment or travel/accommodation costs.
  • Subject to condition 38 above, AVFC's total liability to each Pride Rewards Member in respect of any loss or damage a Pride Rewards Member suffers as a result of a breach of these terms and conditions by AVFC is to credit any Reward Points to the Pride Rewards Member's account which have been wrongly deducted or should have been credited but were not.
  • Subject to condition 38 above, AVFC assumes no responsibility for the services provided by any third party in connection with the Reward Points or the Rewards, including but not limited to the delivery, standard, quality or otherwise of any Reward Points or Rewards provided by third parties or the failure of such a third party to honour the redemption of the Reward Points or make a specific Reward available. Any issues relating to the purchase, delivery and return of Reward Points Rewards should be addressed to the third party.
  • Subject to condition 38 above, AVFC gives no guarantee that any particular Reward will be made available or will remain available. AVFC reserves the right to withdraw or change any Reward and / or amend the number of Reward Points required to claim any Reward at any time.
  • No credit will be issued for any Points or Rewards not redeemed. Points and Rewards may not be purchased with cash, credit card, or cash.
  • Subject to condition 38 above, AVFC will not be liable for lost or stolen Rewards or Reward Points.

General Terms

  • Please note that in clicking through to a retailer site via https://rewards.avfc.co.uk/affiliate, the Club and Fortress GB Ltd act as advertising agents for said retailers and may receive commission from them in return for referring custom and online traffic. A list of participating retailers can be found on the Club’s website (avfc.co.uk) in the list of Club Partners/Reward Affiliates.
  • Each Pride Rewards Member is required to provide AVFC with up to date contact details and keep AVFC informed at all times of any changes to such contact details so AVFC can communicate with Pride Rewards Members.
  • If a Pride Rewards Member has any concerns about their Membership of the Pride Rewards Programme or these terms and conditions, they should contact Consumer Sales, Villa Park, Birmingham B6 6HE (ticketsales@avfc.co.uk). In addition, where the Pride Rewards Member is a consumer, the Pride Rewards Member can obtain further guidance and advice from Citizens Advice (www.adviceguide.co.uk).
  • These terms and conditions, together with (as appropriate): (i) any associated online application form/process; and/or (iii) any other relevant documents, terms or conditions which are explicitly referred to in these terms and conditions comprise the entire agreement between AVFC and a Pride Rewards Member in relation to the Pride Rewards Programme.
  • AVFC may assign or otherwise transfer its rights and obligations under these terms and conditions another organisation within its group of companies provided that:
    • any such transfer shall not adversely impact the Pride Rewards Member and/or their Membership of the Pride Rewards Programme; and
    • it shall use reasonable endeavours to inform Pride Rewards Members of any such transfer (for example, by placing a notice on its website of such transfer).
  • If any of these terms and conditions are found by a court to be illegal, the rest of these terms and conditions will remain in force. Each of the paragraphs of these terms and conditions operates separately. If any court or other relevant authority decides that any of them are unlawful, the remaining paragraphs will remain in full force and effect.
  • This contract is between the Pride Rewards Member and AVFC. No other person shall have any rights to enforce any of its terms.
  • if AVFC delays in enforcing this contract against the Pride Rewards Member, AVFC will be entitled to enforce it at a later stage. If AVFC does not insist immediately that the Pride Rewards Member does anything he/she/it is required to do under these terms and conditions, or if AVFC delays in taking steps against the Pride Rewards Member in respect of him/her/it breaking this contract, that will not mean that the Pride Rewards Member does not have do to those things or that AVFC is prevented from taking steps against the Pride Rewards Member at a later date.
  • These terms and conditions are governed by English law and any legal proceedings must be brought in the English courts. Notwithstanding the foregoing, if the Pride Rewards Member is a consumer and: (i) is resident in Scotland then legal proceedings may be brought in either the Scottish or the English courts; or (ii) is resident in Northern Ireland, then legal proceedings may be brought in either the Northern Irish or the English courts.
